These General Terms and Conditions of Sale (“Terms”) govern all sales concluded through www.cinereplicas.eu.

ARTICLE 2 – PURPOSE

These Terms define the rights and obligations of the parties regarding the online sale of products offered on www.cinereplicas.eu.

They apply to all orders placed by consumers and non-professional customers.

ARTICLE 3 – ACCEPTANCE OF THE TERMS

By placing an order on the Website, the Customer acknowledges having read and accepted these Terms without reservation.

The applicable Terms are those in force on the date the order is placed.

ARTICLE 4 – PRODUCTS

The products offered for sale are those displayed on the Website at the time of consultation.

Photographs, illustrations, descriptions, colours and packaging are provided for illustrative purposes only.

Minor variations in appearance, colour, packaging, finishing or labelling resulting from manufacturing processes, licensors' requirements or screen display settings shall not constitute a defect nor give rise to cancellation, compensation or liability.

ARTICLE 5 – PRODUCT AVAILABILITY

All offers are valid while stocks last.

Should a product become unavailable after an order has been placed, Fame Bros Limited will inform the Customer as soon as reasonably possible.

The Customer may then choose to:

  • wait until the product becomes available;

  • accept an equivalent replacement product;

  • receive a full refund.

No substitute product will be shipped without the Customer's prior consent.

ARTICLE 6 – PRE-ORDERS

Certain products may be offered for pre-order.

Estimated release or availability dates are indicative only and may change due to decisions made by manufacturers, licensors, distributors or other parties involved in the supply chain.

Customers may cancel a pre-order at any time before shipment.

Should the manufacturer or licensor cancel the product or should delivery become permanently impossible, the pre-order shall automatically be cancelled and fully refunded.

Where an order contains both in-stock and pre-order items, Fame Bros Limited may choose either:

  • to ship all products together once the complete order is available; or

  • to split the shipment into multiple deliveries at no additional shipping cost to the Customer.

ARTICLE 7 – PRICES

All prices displayed on the Website are expressed in Euro (€).

Shipping costs are displayed before the Customer confirms the order.

Fame Bros Limited reserves the right to modify prices at any time. However, products will always be invoiced at the price applicable when the order is confirmed.

Obvious pricing errors resulting from technical malfunction or human error shall not bind Fame Bros Limited. In such circumstances, the Customer shall be informed and may either confirm the corrected price or cancel the order without penalty.

ARTICLE 8 – ORDERS

Customers select the products they wish to purchase and add them to their shopping cart.

An order becomes final once:

  • the shopping cart has been validated;

  • these Terms have been accepted;

  • payment has been successfully authorised.

Fame Bros Limited reserves the right to refuse or cancel any order for legitimate reasons, including but not limited to suspected fraud, inaccurate information, abuse of promotional offers, or previous payment disputes.

ARTICLE 9 – PAYMENT

Payment may be made using any payment method offered on the Website at the time of purchase.

Orders will only be processed once payment has been successfully authorised.

Fame Bros Limited uses secure third-party payment providers and never stores complete payment card details.

ARTICLE 10 – FRAUD PREVENTION

To protect both Customers and Fame Bros Limited against fraudulent transactions, additional verification may occasionally be required.

Customers may therefore be requested to provide reasonable proof of identity, address or payment ownership.

Failure to provide the requested information within a reasonable period may result in the suspension or cancellation of the order.

ARTICLE 11 – SHIPPING

Products are shipped to the delivery address provided by the Customer during checkout.

The Customer is solely responsible for ensuring that all delivery information is accurate and complete.

Estimated delivery times displayed on the Website are indicative only.

While Fame Bros Limited will use commercially reasonable efforts to meet estimated delivery dates, such dates cannot be guaranteed.

Delivery delays may notably result from:

  • customs procedures;

  • exceptional logistics disruptions;

  • carrier congestion;

  • force majeure events.

ARTICLE 12 – CUSTOMS, IMPORT DUTIES AND IMPORTATION

For shipments delivered outside the European Union, or to territories applying import formalities, the Customer acts as the importer of record.

The Customer shall be solely responsible for all import duties, customs charges, local taxes, customs clearance fees or any other charges imposed by the destination country.

Fame Bros Limited has no control over such charges and cannot estimate or guarantee their amount.

Where a shipment is refused, abandoned, returned due to unpaid customs charges or cannot be delivered because import formalities are not completed by the Customer, Fame Bros Limited reserves the right to deduct from any refund all actual costs incurred, including return shipping costs, customs charges, administrative fees and destruction fees where applicable.

ARTICLE 13 – TRANSFER OF RISK

The risk of loss of or damage to the Products shall pass to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products.

ARTICLE 14 – RIGHT OF WITHDRAWAL

Consumers have the right to withdraw from their purchase within fourteen (14) calendar days from the date they receive the Products, without giving any reason.

To exercise the right of withdrawal, the Customer must notify Fame Bros Limited by email at support@cinereplicas.com or by using the withdrawal form available on the Website.

The Products must be returned within fourteen (14) days following notification of the withdrawal.

Return shipping costs shall be borne by the Customer unless otherwise required by applicable law.

Returned Products must be complete, unused beyond what is necessary to establish their nature, characteristics and functioning, and returned with their original packaging and any accessories.

The Customer shall remain liable for any diminished value resulting from handling beyond what is reasonably necessary.

ARTICLE 15 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with applicable consumer protection legislation, the right of withdrawal does not apply, in particular, to:

  • products made to the Customer's specifications or clearly personalised;

  • sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed after delivery;

  • sealed audio, video or software products once unsealed after delivery;

  • any other products or services falling within a statutory exception to the right of withdrawal.

ARTICLE 16 – REFUNDS

Where the Customer validly exercises the right of withdrawal, Fame Bros Limited shall reimburse all payments relating to the returned Products.

Refunds shall be processed within fourteen (14) days from receipt of the withdrawal request.

However, Fame Bros Limited may withhold reimbursement until the returned Products have been received or until the Customer has supplied satisfactory proof of return shipment, whichever occurs first.

Refunds shall be made using the same payment method originally used by the Customer unless otherwise agreed.

ARTICLE 17 – LEGAL GUARANTEES

Consumers benefit from all mandatory statutory guarantees applicable under the consumer protection legislation of their country of habitual residence.

Where required by applicable law, Fame Bros Limited shall remedy any lack of conformity existing at the time of delivery in accordance with such legislation.

Nothing in these Terms excludes, limits or restricts any mandatory consumer rights granted by applicable law.

ARTICLE 18 – PRODUCT DEFECTS

Where a Product is defective or does not conform to the order, the Customer shall notify Fame Bros Limited as soon as reasonably possible after discovering the issue.

Fame Bros Limited may request photographs or additional information to assess the claim.

Where the claim is accepted, Fame Bros Limited will provide an appropriate remedy in accordance with applicable law, which may include repair, replacement, price reduction or refund.

ARTICLE 19 – RETURN PROCEDURE

Before returning any Product, Customers must contact Customer Support at support@cinereplicas.com in order to receive return instructions.

Returns made without prior contact may experience delays in processing.

Unless otherwise instructed, Products shall be returned to the return address communicated by Customer Support.

ARTICLE 20 – UNDELIVERED OR RETURNED PARCELS

Where a parcel is returned because of:

  • an incomplete or incorrect delivery address provided by the Customer;

  • repeated absence of the recipient;

  • an unclaimed parcel;

  • refusal to accept delivery;

Fame Bros Limited may either:

  • arrange a new shipment at the Customer's expense; or

  • issue a refund after deduction of any actual shipping, return, administrative or handling costs incurred.

ARTICLE 21 – LIABILITY

Fame Bros Limited shall not be liable for indirect, incidental, consequential or economic losses arising from the use of its Products.

Nothing in these Terms shall exclude or limit any liability that cannot legally be excluded under applicable law.

Fame Bros Limited shall not be liable where failure to perform its obligations results from:

  • the Customer's own actions or omissions;

  • an unforeseeable act of a third party beyond its reasonable control;

  • an event of force majeure.

ARTICLE 22 – FORCE MAJEURE

Fame Bros Limited shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control.

Such events include, without limitation:

  • natural disasters;

  • fires;

  • pandemics;

  • armed conflicts;

  • cyberattacks;

  • general transport strikes;

  • exceptional supply shortages;

  • customs restrictions;

  • governmental measures;

  • any other event qualifying as force majeure under applicable law.

ARTICLE 23 – LOYALTY PROGRAMME AND REFERRALS

Where the Website offers a loyalty or referral programme, participation shall be subject to the conditions published on the Website at the relevant time.

Fame Bros Limited reserves the right to amend, suspend or terminate such programmes upon reasonable notice.

Points, rewards or promotional benefits have no cash value and may not be exchanged for money.

ARTICLE 24 – CONSUMER DISPUTE RESOLUTION

Customers are encouraged to contact Customer Support in order to seek an amicable resolution before initiating any formal dispute.

Consumers residing within the European Union may, where applicable, refer unresolved disputes to the consumer mediation body designated by Fame Bros Limited:

ARTICLE 25 – PERSONAL DATA

Personal data collected through the Website are processed in accordance with the Privacy Policy available on the Website.

ARTICLE 26 – INTELLECTUAL PROPERTY

All content available on the Website, including but not limited to text, graphics, photographs, illustrations, logos, trademarks, videos and designs, is protected by applicable intellectual property laws.

No part of the Website may be reproduced, copied, distributed or exploited without prior written authorisation from Fame Bros Limited.

ARTICLE 27 – GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of France.

Consumers residing in another Member State of the European Union shall continue to benefit from any mandatory consumer protection provisions applicable in their country of habitual residence.

The parties shall endeavour to resolve any dispute amicably before commencing legal proceedings.

Any dispute that cannot be settled amicably shall be submitted to the courts having jurisdiction under the applicable rules of law.

ARTICLE 28 – MODIFICATIONS TO THESE TERMS

Fame Bros Limited reserves the right to amend these Terms at any time.

The version applicable to an order shall always be the version published on the Website at the time the order is placed.


ADDITIONAL PROVISIONS

ARTICLE 29 – PROMOTIONAL CODES, VOUCHERS AND STORE CREDITS

Promotional codes, vouchers, store credits and other promotional benefits issued by Fame Bros Limited are valid only for the period and under the conditions specified at the time of issue.

Unless expressly stated otherwise, promotional codes may not be combined with other offers or promotions.

Promotional codes, vouchers and store credits have no cash value, may not be exchanged for cash and may not be transferred.

If an order benefiting from a promotional offer is cancelled, refunded or partially returned, Fame Bros Limited reserves the right to recalculate the value of the promotion and adjust the refund accordingly.

Where misuse, fraud or abuse of promotional offers is reasonably suspected, Fame Bros Limited reserves the right to cancel the promotion, refuse the order or suspend the relevant Customer account.

ARTICLE 30 – GIFT CARDS

Gift cards issued by Fame Bros Limited are valid for the period indicated at the time of purchase or issue.

Gift cards may only be used on the Website for eligible purchases.

Gift cards cannot be redeemed for cash, refunded or exchanged, except where required by applicable law.

Fame Bros Limited shall not be responsible for lost, stolen, deleted or unauthorised use of gift cards.

If a purchase paid in whole or in part using a gift card is refunded, the refunded amount may be credited back to a new gift card or store credit, unless applicable law requires otherwise.

ARTICLE 31 – CUSTOMER ACCOUNTS

Customers are responsible for maintaining the confidentiality of their account credentials.

Any order placed through a Customer account shall be deemed to have been placed by the account holder unless proven otherwise.

Fame Bros Limited reserves the right to suspend or permanently close any Customer account used fraudulently, abusively or in breach of these Terms.

ARTICLE 32 – OFFICIAL LICENSED PRODUCTS

Cinereplicas products are officially licensed products manufactured under licence agreements with the relevant intellectual property rights holders.

Manufacturers or licensors may occasionally modify packaging, labelling, artwork, colours, accessories or minor product details without prior notice.

Such modifications, provided they do not materially affect the essential characteristics of the Product, shall not constitute a defect and shall not entitle the Customer to cancel the order or claim compensation.

Product photographs and illustrations displayed on the Website are provided for illustrative purposes only.

ARTICLE 33 – CUSTOMER REVIEWS

Where Customer reviews are displayed on the Website, they may originate from Customers who have purchased the relevant Products or from independent review collection platforms.

Fame Bros Limited reserves the right to remove any review that is unlawful, defamatory, abusive, misleading, fraudulent, unrelated to the Product concerned or otherwise contrary to applicable law.

The publication of a review does not imply endorsement by Fame Bros Limited.

ARTICLE 34 – MISUSE OF THE WEBSITE

Fame Bros Limited reserves the right to refuse any order, cancel promotional benefits, suspend Customer accounts or take any other appropriate action where it reasonably believes that a Customer has:

  • committed or attempted fraud;

  • created multiple accounts to obtain promotional advantages;

  • abused promotional offers, referral programmes or loyalty programmes;

  • intentionally disrupted the normal operation of the Website;

  • breached these Terms.

Such measures shall not affect any mandatory rights granted to consumers under applicable law.
